Welcome to my portfolio website. These Terms & Conditions (“Terms”) govern your
access to and use of this website, as well as the professional services provided
by Md. Akir Hossain.

By browsing this website or engaging my services in Graphic Design, Web Design,
or Digital Marketing, you (“Client”, “User”, or “You”) agree to be bound by these
Terms. If you do not agree to these Terms, please do not use this website or engage
in service contracts.

1. SERVICES OFFERED

I provide freelance creative and strategic digital services, including but not
limited to:

• Graphic Design: Brand identity design, logo creation, marketing collateral,
  UI/UX design, print assets, and digital graphics.
• Web Design & Development: Website design, front-end development, CMS setup
  (e.g., WordPress, Webflow, Shopify), website maintenance, and performance optimization.
• Digital Marketing: Search Engine Optimization (SEO), Pay-Per-Click (PPC) ad management,
  social media strategy, conversion rate optimization (CRO), and campaign analytics.

Detailed project scopes, deliverables, timelines, and pricing will be outlined in
a separate Proposal, Statement of Work (SOW), or Service Contract agreed upon by
both parties before project commencement.

2. PROPOSALS, ESTIMATES & SCOPE CREEP

---

• Quotes & Proposals: Written quotes and project proposals remain valid for 30 days
  from the date of issue unless stated otherwise.
• Scope of Work: All project pricing is based on the specific deliverables outlined
  in the agreed Proposal or Statement of Work.
• Scope Creep: Any additional requests, major design revisions beyond agreed rounds,
  or new feature requests not included in the original scope will incur extra charges
  at my current hourly rate ([e.g., $X/hour]) or via a separate project estimate.

3. PAYMENT TERMS & DEPOSITS

• Upfront Deposit: Unless agreed otherwise in writing, a non-refundable deposit of
  [e.g., 50%] is required before any design, development, or marketing work begins.
• Milestone / Final Payments: Remaining balances are payable according to project
  milestones or prior to the transfer of final design assets, website deployment,
  or launch of ad campaigns.
• Late Fees: Invoices unpaid after [e.g., 14/30 days] from the due date may incur a
  late charge of [e.g., 1.5% per month] or the maximum allowed by law on the outstanding
  balance.

4. CLIENT OBLIGATIONS & CONTENT SUBMISSION

• Timely Communication: The Client agrees to provide necessary feedback, approvals,
  and required materials (brand assets, high-res images, copy, access credentials) in a
  timely manner to keep the project on schedule.
• Asset Ownership & Rights: The Client guarantees that all copy, images, trademarks,
  and assets provided to me for incorporation into design, web, or marketing work
  are legally owned or licensed by the Client. The Client assumes full responsibility
  for copyright/trademark claims arising from provided assets.
• Delayed Projects: If a project is delayed by the Client for more than [30 consecutive days]
  without prior agreement, I reserve the right to invoice for completed work and
  pause or reschedule the project.

5. INTELLECTUAL PROPERTY & PORTFOLIO RIGHTS

• Ownership Transfer: Upon full and final payment of all outstanding invoices, ownership
  and copyright of final graphic design assets and custom web code created specifically
  for the Client will be transferred to the Client.
• Retained Rights: I retain ownership of all preliminary concepts, unused design drafts,
  internal source files, and pre-existing code libraries/tools used in creation.
• Portfolio Rights: Unless restricted by a mutually signed Non-Disclosure Agreement (NDA),
  I reserve the right to showcase completed graphic designs, website previews, UI/UX case
  studies, and anonymized marketing results in my online portfolio, social media, and
  promotional materials.

6. DIGITAL MARKETING & ADVERTISING DISCLAIMERS

• No Guarantee of Specific Results: While I apply industry best practices for SEO, PPC,
  and marketing strategies, I cannot guarantee specific revenue, sales, ranking positions,
  or conversion rates, as campaign outcomes depend on market variables, ad network algorithms,
  and third-party platform changes.
• Ad Spend & Third-Party Charges: All direct ad spend (e.g., Google Ads, Meta Ads)
  and third-party platform subscriptions (e.g., domain registration, web hosting, plugin
  licenses) are the sole financial responsibility of the Client and are paid directly
  to the respective third-party providers.

7. WEBSITE MAINTENANCE & THIRD-PARTY SERVICES

• Post-Launch Support: Web design projects include a [e.g., 14-day or 30-day] bug-fix
  warranty following launch. Ongoing maintenance, server updates, security monitoring,
  and backups require a separate retainer agreement.
• Third-Party Software: I am not liable for downtime, security breaches, software bugs,
  or breaking changes caused by third-party hosting providers, CMS core updates, web
  plugins, or API changes outside my control.

8. CANCELLATION & TERMINATION

• Termination by Client: The Client may cancel a project at any time in writing. Upon
  cancellation, the initial deposit remains non-refundable, and the Client will be billed
  for all hours worked or work completed up to the cancellation date.
• Termination by Service Provider: I reserve the right to terminate a project immediately
  if the Client engages in abusive behavior, fails to make required payments, or breaches
  these Terms.
• Delivery of Partial Work: In the event of early termination, any completed or partial
  work paid for by the Client will be delivered to the Client “as-is”.

9. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, [Your Business Name] shall not be
liable for any indirect, incidental, consequential, special, or punitive damages,
including lost profits, loss of data, business disruption, or commercial loss arising
from website downtime, design errors, or digital marketing campaign performance.

My total aggregate liability under any contract or claim shall not exceed the total amount
actually paid by the Client to me for the specific project or service in dispute.

10. GOVERNING LAW & JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of
